Income Tax Instruction No: 01/ 2005 dt.18-Mar-05- Discontinuance of Advice
Notes issued with Income Tax Refund Orders for Refunds up to Rs. 24.999/-
To
All Chief Commissioners of Income Tax & Directors General of Income Tax.
Reference Is invited to the following Circulars/ Instructions issued by
DOMS/CBDT from time to time wherein the procedure for issue of Refund
Orders was detailed: -
(1) DOMS Circular No. 3 dated 15.7.1980.
(ii) DOMS Circular No. 54 dated 16.12.1987
(iii) DOMS Instruction No. 58 dated 8.2.1988
(iv) CBDT Instruction No. 15/2003 dated 6.11.2003
2. With a view to improve Taxpayers service, the Board has decided to
discontinue the system of sending Advice Notes to the bank separately in
cases of refunds up to Rs. 24,999/-. Under the new system, no Advice Note
would be generated for refund orders up to an amount of Rs.24.999/-. For
refund orders of Rs. 25.000/- and above, one Advice Note would be made,
which would be sent to the Main Branch of State Bank of India. One
counterfoil of the refund cheque would continue to be retained by the
assessing officer for all refunds Issued by him regardless of the amount of
refund. All refunds of Rs. 25.000/- and above will now be drawn on only the
Main Branch of State Bank of India. The other branches in any station will
handle refunds only up to Rs.24,999/-.
3. The above changes in refund procedure will involve the following steps:-
(a) Issue of fresh refund stationery for different direct taxes with
cheques drawn on various branches of State Bank of Indiawith their
respective MICR codes.
(b) Issue of new types of refunds stationery for different direct taxes:
(i) for refunds up to Rs. 24.999/- (one refund cheque for assessee and one
counterfoil to be retained by the Assessing Officer).
(ii) for refunds of Rs. 25,000/- and above (one refund cheque for assessee,
one advice note to be sent to the Main Branch of State Bank of India and
one counterfoil to be retained by Assessing Officer.
(c) Distribution of the new refund stationary to all assessing officers.
Each assessing officer would receive one set of refund stationary for
refunds up to Rs.24,999/- for Corporation Tax and Income Tax and another
set of refund stationery for refunds of Rs.25,000/- and above for
Corporation Tax and Income Tax. Similarly, separate refund stationery for
Wealth Tax and other direct taxes would also be distributed.
(d) Surrender of unused old refund stationery by all assessing officers to
DIT(RSP&PR) after the new stationery is introduced.
4. Steps in this regard have already been Initiated by the Directorate of
System and Directorate of RSP&PR and the new refund stationery shall be
made available at all Held stations before the date of switchover to the
new system. Necessary steps for distribution of new refund stationery,
surrender of unused old stationery and Informing the assessing officer of
the new procedure of issuing refund orders have to be taken by the Chief
Commissioners/Directors General.
5. The monetary celling of Rs.24,999/- for issuance of refunds without an
Advice Note would also apply to Wealth Tax, Gift Tax and all other direct
taxes.
6. The Instructions Issued earlier on the subject may be treated as amended
to the extent indicated above. The security measures and other instructions
mentioned In the earlier Circulars/ Instructions will however continue to
be followed scrupulously.
7. The new refund procedure Is proposed to be introduced with effect from
1.4.2005. However, the exact date of switchover to the new refund system
will be communicated to the Board by a separate order.

A (male) is married to B (female)
A & B jointly (50:50) own a house in a City. No other house is owned by A. Both of them live in the jointly owned house. A works in a Company, where HRA is a Salary component. A pays rent to B for the 50% share of the house owned by B and submits the rent proof to the company.

RBI hikes repo rate by 25bps
RBI governor Y V Reddy has hiked the repo rate by 25 basis points. The GDP
forecast has been cut to 6-6.5% and inflation
outlook upped to 6% from 5%.
The RBI has increased its signal interest rate - the repo rate by a quarter
percent to 4.75%, in the credit policy announced by
RBI Governor Y V Reddy today.
While indicating that growth and price stability will be balanced, the RBI has
signalled that inflation management will take
precedence. It has also increased it’s inflation target sharper than expected
to 6.5% from the earlier 5%.
The mid term review has lowered the GDP growth target to 6 to 6.5%. It had
earlier forecast growth at between
6.5 to 7%. The RBI says high oil prices and a deficient monsoon that came in at
87% of normal will hurt growth.
It warns that even this target could get upset by sharper than expected rises
in oil prices or a global slowdown.
The RBI expresses concerns over oil prices and says that the effects of the
increase here are yet to be
fully played out in the domestic economy. The bank says there are clear signs
of a pick up in investment
demand as indicated by strong growth in capital goods imports.
There is evidence that corporate expansion plans have been bought forward and
scaled up. As a result the
bank expects the growth of non-food credit is expected to increase by 19%
against an earlier projected 16.5%.
Following are highlights of the credit policy:
The bank rate has been left unchanged at 6%.
The repo rate has been hiked by 25 basis points, to 4.75%
The reverse repo rate has been left unchanged
GDP target has been lowered to 6-6.5%
Average inflation rate for the year has been raised by a whole 100 bps to 6.5%
from 5%.
Composite loan limit for SSI up from Rs 50 lakh to Rs 1 crore
The Cash Reserve Ratio, CRR, has been left unchanged
RBI has said that agriculture growth of 3% is unlikely to materialise
7 and 14 day Repos will be discontinued from November 1
M3 growth is projected lower at 5.4% this year, against 7.8%
Projected expansion of money supply has been retained at 14%.
Credit demand has been “far more than anticipated”, says the RBI
Non-Food credit is seen rising 19%, upped from the earlier call of a 16
–16.5% gain.
Global capital flows outlook is still seen positive
Ceiling on NRE rates has been raised to LIBOR plus 50 basis points
It says that capital goods import strength shows revival of investment demand
Current account surplus is likely to stay despite increase in imports
The government has completed 29% of the budgeted net borrowing target at Rs
26,233 crore,
and has completed 49.8% of the targeted gross borrowing target at Rs 75,044
crore, says the RBI
Central government revenue deficit is higher by 3.5% at Rs 62,906 crore, upto
August 2004,
compared to the same period last year. The gross fiscal deficit is up by about
20.8% at Rs 52,509
crore upto August 2004 compared to the same period last year.
Priority sector limit advances have been enhanced to improve farm credit.
Banks will increase disbursements to small and marginal farmers under the
Special Agricultural
Credit Plan, SACP, March 2007
Private banks have been urged to formulate SACPs from 2005-06 targeting annual
growth of 20-25%

I-Sec says that the hike in repo rate has been as per expectation, and is a
logical step. It says

another rate hike in the next few months, and says that the 10-year yield may
touch 7% in the next few weeks.

Convergence - Basel II To Transform Banks’ Data Storage Needs, Says EMC

The implementation of Basel II norms by the top 100 Indian banks by
December 2006 will create new business opportunities in network storage,
according to the global external storage major EMC Corp.
Basel II is about tackling operational risks that the banking sector faces
in data security, human error and technology.
The banks have to take initiatives in disaster recovery and business
continuity plans to ensure proper management of security and storage of
banking data and customer information.
EMC reckons that, in the current year, the network storage market is poised
for a comfortable double-digit growth which will be the same as the Indian
IT industry’s annual growth.
During 2003-04, the network storage market was worth Rs 700 crore. Overall,
the IT industry is expected to grow by around 25 per cent in the current
year over 2003-04.
EMC, a $6 billion provider of information management solutions, is aiming
for the Indian public sector banks as well as the private sector ones.
EMC’s network storage applications range from hardware and software to
services solutions.
EMC, which opened its India office in 2000, has at present only foreign
banks like Citibank and AMN Amro as its customers, apart from Indian
telecom service providers and software companies like Bharti Televentures,
Hutchison Essar and Wipro.
Now, EMC is looking for Indian banks as customers since they are ready to
invest half their total capital expenditure for IT in storage solutions.
EMC’s director of financial services industry for South Asia, Ian Loh,
while airing his views on the issue, said that in the next few years the
Indian banks would have to go for secured network storage architecture.
"Apart from the Basel II compulsion, the Indian banks will have to realise
the importance of the separation between the processing of information and
the storage of information," informed Mr Loh.
The banks have to move from PC-Server based storage to virtual storage with
network storage applications in place.
Salaried Taxpayers In 12 Cities Can Get Refunds Directly Credited In
Respective Bank Accounts.
The Income Tax Department has introduced Electronic Clearance Scheme
(ECS) for refunds upto Rs. 25,000/- in cases of salaried taxpayers filing
returns in Form 2E (Naya Saral)
http://www.incometaxindia.gov.in/Forms/2ESaral.pdf. This Scheme is
available to taxpayers in 12 cities, namely, New Delhi, Mumbai, Chennai,
Ahmedabad, Bhubaneshwar, Nagpur, Kanpur, Bangalore, Hyderabad, Patna,
Kolkata and Thiruvanthapuram. Once the return is processed the refund
(if any) will be credited directly to the bank account indicated in the
return of income. Taxpayers wishing to avail of this Scheme should
indicate required bank details on the return of income. To this end, the
Central Board of Direct Taxes has recently notified modified form 2E for
salary returns that contains columns for providing details of bank
accounts. Modified Form 2E may be downloaded from the website or
obtained on fax or email from Aaykar Sampark Kendra (ASK) by dialing
0124-2438000.
FM offers some income tax relief

Finance Minister P Chidambaram on Thursday provided some relief to income
tax assesses earning marginally above the Rs 100,000 limit.
The finance minister has also deferred by a year the decision to tax NRI
deposits and leasing of aircraft through official amendments to the Finance
Bill, which was passed without discussion in the Lok Sabha.
Voicing his 'unhappiness' over the Finance Bill being passed without a
debate, Chidambaram told reporters that he has broadly addressed the
concerns expressed in various quarters regarding the tax proposals in the
Finance Bill.

Giving details of the amendments after the passage of the Bill, the finance
minister said he had also removed certain 'ambiguity' in the definition of
'relative' and unrelated persons for benefits under the gift tax
provisions.
There was some confusion on filing of Annual Information Report by income
tax assessees, which would be only for very high value transactions to be
defined shortly.
Amendment has been brought in this regard as well, he said, adding that
through another amendment the panel provision under section 227 (A) for
falsification of book of accounts have been lifted.
Asked what constituted 'marginal' for providing relief to income tax
assessees, Chidambaram said those whose taxable income is up to Rs 109,000
would get the benefit.
This has been necessitated as persons with income up to Rs 100,000 have
been exempted from income tax, while those beyond Rs 100,000 would have to
pay tax on their income from Rs 50,000 onwards resulting in an anomalous
situation wherein the real income of a person earning Rs 110,000 is much
less than those earning up to Rs 100,000.
Regarding tax on Non-Resident Indian and Non-Resident External deposits,
Chidambaram said it had been deferred till April 2005.
The provision remains and would be taken up after widest consultations as
part of the efforts to debate Kelkar panel recommendations.
So also the provision to tax leasing of aircraft has been deferred till
April 2005, he said, adding that this has been done following the request
from the Civil Aviation Minister Praful Patel even though most of the
leasing of aircraft by Indian Airlines, Air-India and private airlines has
already been done.
He said amendments have also been made to incorporate the changes announced
in the securities transactions tax.
Chidambaram has modified the securities transaction rates and exempted the
day traders from it while replying to budget debate in Lok Sabha last
month.
Chidambaram also said he was 'disappointed' that the Appropriation and
Finance Bills have been passed without discussion. "I am not happy," he
said, adding that the "Finance Bill should be debated on the floor of the
House and replied to on floor of the House."

| If you have been using the Internet for any length of time, and especially if

| heard the term firewall used. For example, you often hear people in companies
say |
| things like, "I can't use that site because they won't let it through the
firewall." |

| If you have a fast Internet connection into your home (either a DSL connection

| cable modem), you may have found yourself hearing about firewalls for your
home |
| network as well. It turns out that a small home network has many of the same
security |
| issues that a large corporate network does. You can use a firewall to protect
your |
| home network and family from offensive Web sites and potential hackers.

| property. In fact, that's why its called a firewall. Its job is similar to a
physical |
| firewall that keeps a fire from spreading from one area to the next. As you
read |
| through this edition of HowStuffWorks, you will learn more about firewalls,
how they |
| work and what kinds of threats they can protect you from.

What It Does
A firewall is simply a program or hardware device that filters the
information coming through the Internet connection into your private
network or computer system. If an incoming packet of information is flagged
by the filters, it is not allowed through.
If you have read the article How Web Servers Work, then you know a good bit
about how data moves on the Internet, and you can easily see how a firewall
helps protect computers inside a large company. Let's say that you work at
a company with 500 employees. The company will therefore have hundreds of
computers that all have network cards connecting them together. In
addition, the company will have one or more connections to the Internet
through something like T1 or T3 lines. Without a firewall in place, all of
those hundreds of computers are directly accessible to anyone on the
Internet. A person who knows what he or she is doing can probe those
computers, try to make FTP connections to them, try to make telnet
connections to them and so on. If one employee makes a mistake and leaves a
security hole, hackers can get to the machine and exploit the hole.
With a firewall in place, the landscape is much different. A company will
place a firewall at every connection to the Internet (for example, at every
T1 line coming into the company). The firewall can implement security
rules. For example, one of the security rules inside the company might be:
Out of the 500 computers inside this company, only one of them is
permitted to receive public FTP traffic. Allow FTP connections only
to that one computer and prevent them on all others.
A company can set up rules like this for FTP servers, Web servers, Telnet
servers and so on. In addition, the company can control how employees
connect to Web sites, whether files are allowed to leave the company over
the network and so on. A firewall gives a company tremendous control over
how people use the network.
Firewalls use one or more of three methods to control traffic flowing in
and out of the network:
· Packet filtering - Packets (small chunks of data) are analyzed
against a set of filters. Packets that make it through the filters are sent
to the requesting system and all others are discarded.
· Proxy service - Information from the Internet is retrieved by the
firewall and then sent to the requesting system and vice versa.
· Stateful inspection - A newer method that doesn't examine the
contents of each packet but instead compares certain key parts of the
packet to a database of trusted information. Information traveling from
inside the firewall to the outside is monitored for specific defining
characteristics, then incoming information is compared to these
characteristics. If the comparison yields a reasonable match, the
information is allowed through. Otherwise it is discarded.
Making the Firewall Fit
Firewalls are customizable. This means that you can add or remove filters
based on several conditions. Some of these are:
· IP addresses - Each machine on the Internet is assigned a unique
address called an IP address. IP addresses are 32-bit numbers, normally
expressed as four "octets" in a "dotted decimal number." A typical IP
address looks like this: 216.27.61.137. For example, if a certain IP
address outside the company is reading too many files from a server, the
firewall can block all traffic to or from that IP address.
· Domain names - Because it is hard to remember the string of numbers
that make up an IP address, and because IP addresses sometimes need to
change, all servers on the Internet also have human-readable names, called
domain names. For example, it is easier for most of us to remember
www.howstuffworks.com than it is to remember 216.27.61.137. A company might
block all access to certain domain names, or allow access only to specific
domain names.
· Protocols - The protocol is the pre-defined way that someone who
wants to use a service talks with that service. The "someone" could be a
person, but more often it is a computer program like a Web browser.
Protocols are often text, and simply describe how the client and server
will have their conversation. The http in the Web's protocol. Some common
protocols that you can set firewall filters for include:
§ IP (Internet Protocol) - the main delivery system for information
over the Internet
§ TCP (Transport Control Protocol) - used to break apart and rebuild
information that travels over the Internet
§ HTTP (Hyper Text Transfer Protocol) - used for Web pages
§ FTP (File Transfer Protocol) - used to download and upload files
§ UDP (User Datagram Protocol) - used for information that requires no
response, such as streaming audio and video
§ ICMP (Internet Control Message Protocol) - used by a router to
exchange the information with other routers
§ SMTP (Simple Mail Transport Protocol) - used to send text-based
information (e-mail)
§ SNMP (Simple Network Management Protocol) - used to collect system
information from a remote computer
§ Telnet - used to perform commands on a remote computer
A company might set up only one or two machines to handle a specific
protocol and ban that protocol on all other machines.
· Ports - Any server machine makes its services available to the
Internet using numbered ports, one for each service that is available on
the server (see How Web Servers and the Internet Work for details). For
example, if a server machine is running a Web (HTTP) server and an FTP
server, the Web server would typically be available on port 80, and the FTP
server would be available on port 21. A company might block port 21 access
on all machines but one inside the company.
· Specific words and phrases - This can be anything. The firewall will
sniff (search through) each packet of information for an exact match of the
text listed in the filter. For example, you could instruct the firewall to
block any packet with the word "X-rated" in it. The key here is that it has
to be an exact match. The "X-rated" filter would not catch "X rated" (no
hyphen). But you can include as many words, phrases and variations of them
as you need.
A software firewall, such as ZoneAlarm, can be installed on the computer in
your home that has an Internet connection. This computer is considered a
gateway because it provides the only point of access between your home
network and the Internet.
With a hardware firewall, the firewall unit itself is normally the gateway.
A good example is the Linksys Cable/DSL router. It has a built-in Ethernet
card and hub. Computers in your home network connect to the router, which
in turn is connected to either a cable or DSL modem. You configure the
router via a Web-based interface that you reach through the browser on your
computer. You can then set any filters or additional information.
Hardware firewalls are incredibly secure and not very expensive. Home
versions that include a router, firewall and Ethernet hub for broadband
connections can be found for well under $100.
What It Protects You From
There are many creative ways that unscrupulous people use to access or
abuse unprotected computers:
· Remote login - When someone is able to connect to your computer and
control it in some form. This can range from being able to view or access
your files to actually running programs on your computer.
· Application backdoors - Some programs have special features that
allow for remote access. Others contain bugs that provide a backdoor, or
hidden access, that provides some level of control of the program.
· SMTP session hijacking - SMTP is the most common method of sending
e-mail over the Internet. By gaining access to a list of e-mail addresses,
a person can send unsolicited junk e-mail (spam) to thousands of users.
This is done quite often by redirecting the e-mail through the SMTP server
of an unsuspecting host, making the actual sender of the spam difficult to
trace.
· Operating system bugs - Like applications, some operating systems
have backdoors. Others provide remote access with insufficient security
controls or have bugs that an experienced hacker can take advantage of.
· Denial of service - You have probably heard this phrase used in news
reports on the attacks on major Web sites. This type of attack is nearly
impossible to counter. What happens is that the hacker sends a request to
the server to connect to it. When the server responds with an
acknowledgement and tries to establish a session, it cannot find the system
that made the request. By inundating a server with these unanswerable
session requests, a hacker causes the server to slow to a crawl or
eventually crash.
· E-mail bombs - An e-mail bomb is usually a personal attack. Someone
sends you the same e-mail hundreds or thousands of times until your e-mail
system cannot accept any more messages.
· Macros - To simplify complicated procedures, many applications allow
you to create a script of commands that the application can run. This
script is known as a macro. Hackers have taken advantage of this to create
their own macros that, depending on the application, can destroy your data
or crash your computer.
· Viruses - Probably the most well-known threat is computer viruses. A
virus is a small program that can copy itself to other computers. This way
it can spread quickly from one system to the next. Viruses range from
harmless messages to erasing all of your data.
· Spam - Typically harmless but always annoying, spam is the electronic
equivalent of junk mail. Spam can be dangerous though. Quite often it
contains links to Web sites. Be careful of clicking on these because you
may accidentally accept a cookie that provides a backdoor to your computer.
· Redirect bombs - Hackers can use ICMP to change (redirect) the path
information takes by sending it to a different router. This is one of the
ways that a denial of service attack is set up.
· Source routing - In most cases, the path a packet travels over the
Internet (or any other network) is determined by the routers along that
path. But the source providing the packet can arbitrarily specify the route
that the packet should travel. Hackers sometimes take advantage of this to
make information appear to come from a trusted source or even from inside
the network! Most firewall products disable source routing by default.
Some of the items in the list above are hard, if not impossible, to filter
using a firewall. While some firewalls offer virus protection, it is worth
the investment to install anti-virus software on each computer. And, even
though it is annoying, some spam is going to get through your firewall as
long as you accept e-mail.
The level of security you establish will determine how many of these
threats can be stopped by your firewall. The highest level of security
would be to simply block everything. Obviously that defeats the purpose of
having an Internet connection. But a common rule of thumb is to block
everything, then begin to select what types of traffic you will allow. You
can also restrict traffic that travels through the firewall so that only
certain types of information, such as e-mail, can get through. This is a
good rule for businesses that have an experienced network administrator
that understands what the needs are and knows exactly what traffic to allow
through. For most of us, it is probably better to work with the defaults
provided by the firewall developer unless there is a specific reason to
change it.
One of the best things about a firewall from a security standpoint is that
it stops anyone on the outside from logging onto a computer in your private
network. While this is a big deal for businesses, most home networks will
probably not be threatened in this manner. Still, putting a firewall in
place provides some peace of mind.
Proxy Servers and DMZ
A function that is often combined with a firewall is a proxy server. The
proxy server is used to access Web pages by the other computers. When
another computer requests a Web page, it is retrieved by the proxy server
and then sent to the requesting computer. The net effect of this action is
that the remote computer hosting the Web page never comes into direct
contact with anything on your home network, other than the proxy server.
Proxy servers can also make your Internet access work more efficiently. If
you access a page on a Web site, it is cached (stored) on the proxy server.
This means that the next time you go back to that page, it normally doesn't
have to load again from the Web site. Instead it loads instantaneously from
the proxy server.
There are times that you may want remote users to have access to items on
your network. Some examples are:
· Web site
· Online business
· FTP download and upload area
In cases like this, you may want to create a DMZ (Demilitarized Zone).
Although this sounds pretty serious, it really is just an area that is
outside the firewall. Think of DMZ as the front yard of your house. It
belongs to you and you may put some things there, but you would put
anything valuable inside the house where it can be properly secured.
Setting up a DMZ is very easy. If you have multiple computers, you can
choose to simply place one of the computers between the Internet connection
and the firewall. Most of the software firewalls available will allow you
to designate a directory on the gateway computer as a DMZ.
