Moot Problem, 25th August 2007

________________________________________________
Karim worked as a system operator at a computer Centre in Jajhhar
Dist., Haryana and lived in the town. His village was at a distance
of 12 kms. from his workplace which he ordinarily visited on
Saturdays and Sundays.
Sher Shah was a farmer who lived with his family consisting of his
wife, Sobti, son Gajendar Shah and a daughter Naina. Sher Shah's
brother, Suri Shah, also lived in the same household. He was used to
drinking and gambling and owed a debt of Rs. 20,000 to Karim.
Whenever Karim demanded his money, Suri Shah showed his helplessness
but never denied to pay off his debt. Karim was in love with Naina
and used to meet Naina on the weekends when her father was not at
home on the pretext that he had come to collect the money.
Sher Shah did not like it and told Karim many a times not to visit
his home in his absence. He also scolded his daughter for meeting
Karim but Karim did not stop visiting Naina.
During the day on Monday, 8th August 2005, Karim received a phone
call from Suri Shah inviting him to come that evening to collect his
debt. Karim went to their house around 8.30 P.M. The members of
Naina's family had finished their dinner and were preparing to go to
sleep. On hearing some whispering voices coming from the backyard
of their house, Sher Shah with his brother Suri Shah and son
Gajendar Shah went there to investigate.
They saw Karim talking with Naina. Sher Shah lost his temper and
started abusing Karim. Gajendar Shah brought a lathi from inside and
gave a blow to Karim on the leg. Then Suri Shah grabbed the lathi
from Gajendar Shah and started beating Karim mercilessly giving
blows on his head and chest.
On hearing the hue and cry, other villagers came to the scene. They
found Suri Shah giving blows to Karim while the other two were
shouting abuses on Karim. Karim was bleeding from the head and
became unconscious. He was taken to the hospital by the villagers
where he died three days later without regaining consciousness. The
post-mortem report confirmed that Karim suffered injuries on the
head and fractures of three ribs. There were many concussions on
different parts of his body. There was much loss of blood. While
none of the injuries independently was sufficient to cause death,
the cumulative result was sufficient in the ordinary course of
nature to cause death.
FIR was registered against Suri Shah, Gajendar Shah and Sher Shah
under Section 307 read with S. 34 of the Indian Penal Code. Three
days later when Karim died, it was changed to Section 302 r/w 34
IPC. The session court charged and convicted all the three accused
persons under Section 302 r/w 34 of the IPC and sentenced them to
life imprisonment for the murder of Karim. The accused persons
pleaded grave and sudden provocation in their defence. They also
pleaded that the prosecution had failed to prove existence of common
intention of all the three accused to kill Karim. In the absence of
proof of common intention, they cannot be convicted under Section
302 r/w 34 IPC.
The three accused have filed separate appeals to the High Court
against the order of conviction and sentence. The matter is listed
for arguments on 25th Aug, 2007 limited to the question of
conviction.

Dear All,
This year for the first time we held pre-election speaches by all the
candidates before the LC-I Students Unions Election. One of the
things that we wanted them to speak was on 'LC-I of My Dreams'.
To say the least I was personally very disappointed to hear their
speeaches. Since then I have raised this topic in the LL.B. first
year which I am teaching currently and asked them to right a small
piece on the topic. Imagine that you have no financial contraints and
you are free to do whatever needs to be done to create the best
institution for legal education.
What would be your dream for LC-I? What it would be like? What all
would it have? What all would it be doing? Who will it be producing?

What will LC-I of your Dreams be like?

I will be happy to read your well thought out dream LC-I, and I
think, so will be other members of the Mooters Society. I believe
that students and ex-students who are members on this website, will
share thier views with others and lets try to first conceive that LC-
I of My Dreams and thereafter work togethe so that dream materialises.

I invite all members to share thier thoughts on the topic.
Best regards
Ved

PS: If you know other students of Lc-I, past and present, who are not
members on this group, please share the topic with them and encourage
them to join us on this group and share their opinions and dreams.

Respected Madam,
I am a first year student in the evening batch. Since I am relatively
new to the place I may not be fully aware of all that happens at LC-
1, and my views may not be entirely correct. So instead of writing to
all the members of the mooters' society, I took the liberty of writing
to you.(As a teacher you might have corrected some incorrect answers,
so this may also be viewed in a similar vein)

I did not attend the programme where candidates gave pre-election
speeches. Like most of my classmates in the evening section, I too
was of the opinion that the time would be better utilised attending
the lecture on Criminal Law instead. So I don't know what the
candidates said.
Not that I am fond of studies. Quite the contrary. Its just that,
those of us who work during the day, study very little, and thus if
nothing else, atleast in conscience "feel better" to be inside a
class than out of it. (However, going by your observations on the
election speeches, I do not seem to have missed much!)

'I have a dream' - was famously said by Martin Luther King. His
fellow American, President Kennedy was more practical - 'Ask not what
America can do for you, but what you can do for America'.
When one thinks of the LC-1 of one's dream, the mind readily conjures
an image of a place full of facilities. Rarely does it cross the
mind, that such a place needs one's ideas, efforts and time to first,
come true.

To my limited understanding, a centre of excellence, stimulates the
minds of students to not only read the curriculla, but go beyond.
Towards this end, LC-1 already has certain avenues such as the
Mooters' Society and the Legal Aids Society to name a few. The
Cultural Society recently screened 'Provoked' based on the celebrated
case of Kiranjeet Ahluwalia. Those who look forward to practice can
avail of internships with law firms for a 'hands-on' experience.
Sometimes it might be a good idea to do these existing activities
well rather than crowd them out with more 'new' things.

At the same time in a changing world, one needs flexibility to adapt,
particularly to changes in the field of technology.
The LC-1 library could do with a few more computers. Subscriptions to
on-line databases (e.g. manupatra etc.) may also prove to be useful,
though expensive.
Two or three library staff members could also be deputed (for a
suitable honorarium) to keep the Library open on Sundays. After all,
most of the evening students work, and half of LC-1 is in the
evening. So Sunday is the only free day that they have.

The classrooms need mikes for the teachers. No doubt our respected
teachers teach very well, but I would humbly submit that they may be
able to perform better without having to strain their vocal chords
continously. The argument that earlier teachers of great eminence
were able to manage without mikes (and the new ones will get used
soon!), does not appear to wash. Even today, there are people in
villages who manage without ceiling fans. But is it a model worth
emulating?
Much like mobile technology, the price of electronic goods has been
falling, and to my mind, installation of Public Address (PA) Systems
in all classrooms should be an affordable proposition.

A waste-paper basket in every classroom might not be out of place,
given the propensity to litter. Ofcourse getting students (me
included) to use them, might be a bit more difficult.
And yes, it would be nice if the toilets could be cleaned every day.

The car park could be tiled and car lanes marked to prevent haphazard
parking. This will enable more cars to be accomodated. This would be
a one time investment, and would make the place look neater.

In our classes there is already a laudable practice followed by some
teachers who after finishing a chapter, spare a period to revise the
topic with the help of possible questions. It would be great if this
could regularly be done in all subjects.

Returning to Kennedy, well...on my part I will try to study and take
part in some of the activities of the centre. (And ofcourse I will
try to use the waste-paper basket, if there is one)

During the mooting workshop (which I could luckily attend by sneaking
out of office), when the issue of good memorials was discussed, -
Stetson Law University was cited as a possible source.
So should we try to make LC-1 into a Yale or a Stetson? Or is it an
impossible dream?
I am not sure...but then, Martin Luther King's dream did come true.

With regards,

Shankar Dhar

Law Centre 1 of My Dreams

My small briefing starts with this small poem of Gurudev. Our LC -1 will
be of this kind.

Where The Mind is Without Fear

Where the mind is without fear and the head is held high
Where knowledge is free
Where the world has not been broken up into fragments
By narrow domestic walls
Where words come out from the depth of truth
Where tireless striving stretches its arms towards perfection
Where the clear stream of reason has not lost its way
Into the dreary desert sand of dead habit
Where the mind is led forward by thee
Into ever-widening thought and action
Into that heaven of freedom, my Father, let my country awake

Rabindranath Tagore

Law Centre 1

1. Where every student when he reads the Preamble to
our Constitution, he/she feels a vibration and gets inspiration to turn
these sacred words into reality.

2. Where we all strive for the development of our minds
in order to become not only good lawyers but also to become good human
beings.

3. Where there is a wave of exercises which enhance our
capacity as a law student, give us an open sky to think, develop &
contribute to what we study.

4. Where the students are activelly engaged in giving
back to the society through their legal acumen for their development.

5. Where when it comes to pointing out towards one
institution in the country which is immensely contributing towards both
: producing top class lawyers and also developing legal minds who will
enrich legal framework through their researches, it should be our Law
Centre -1

6. Where the education becomes most powerful weapon of
building our characters on the righteous lines. As Prof. Ved says I/we
are units of this society and when we talk about changing society on the
right lines, we should first put us on the right lines.

7. Where, the words "Law Centre 1",
whenever spoken before us, even after 20, 30 or 40 years, we feel full
of pride and our presence becomes a thing of esteem among others.

8. Where, every student feels that he/she is ready to
contribute towards development of our institution through whatever small
effort he/she can do. Ready to be a drop in the ocean. Ready to be a
small stone to start a small wave that will become a tsunami later.

9. Where the students studying are having an edge over
others when it comes to lawyering skills, and at the same time they are
ready to utilise their knowledge for helping the poor masses to get
their due.

10. Where every year only one, I don't desire more but
only one, only one M.C. Mehta is produced.

Dreams are big, the stone is very heavy, so heavy that is very difficult
to move it, but not impossible to move it. We will move the stone. We
are on to move the stone, we have plans and we will execute them.
Wishing you all very best.
