Greetings from Parivartan.
I am Divya Jyoti Jaipuriar, an advocate attached with Public Cause Research
Foundation (A Parivartan Initiative) and am practicing in Delhi High Court
handling primarily cases on the issues of RTI Act.
I am writing you to invite you for a workshop and meeting of RTI Activists
and Lawyers of the state to discuss about the problems we are facing in
implementation and interpretation of the Act. The meeting is scheduled for
Sunday 16th March 2008 at Patna Youth Club, Near Gandhi Maidan, Patna.
The Central Information Commission, for example, is accepting the excuse of
Public Authorities that the related information is not available in office
as the concerned file is lost/ untraceable. They are not using their powers
under section 18 to establish the malafide in denying information. We have
already filed more than 30 case challenging orders of CIC in Delhi high
Court. But it is felt that if the functionaries of the RTI Act are to be
streamlined, the cased of denial of information and actions of the
Information Commissions- both Central and State- must be challenged in
different high courts. Apart from these, there is also a need to file a
number of Public Interest Litigation to challenge various rules and
regulations framed by different authorities. For example, the rules framed
by different High Courts are so bad that at times, these rules even amend
the RTI Act itself. By these rules, High Courts try to incorporate new
exemption clauses for denying information. These rules are required to be
challenged in respective high courts as well.
Apart from these, PILs are also required to be filed in High Courts for
implementation of section 4 of the Act and also to get guidelines and
directions for Public Authorities and Information Commission for proper
implementation and interpretation of the RTI Act.
In this endeavour, I have been given a responsibility of developing a
network of lawyers all across the country. I am happy that Human Rights Law
Network (HRLN) has volunteered all its state offices and Lawyers for the
cause of Right to Information Act. Lawyers from HRLN and other like minded
groups and individual Lawyers are meeting RTI Activists of the State in
almost every state and in the meeting, the strategy is designed and decided
to take forward the movement of RTI and to support the movement in the
Courts. In this continuing effort, we plan to meet in Patna on 16th March
2008 at Patna Youth Club for a one day meeting cum workshop on RTI where
lawyers from HRLN and other associate groups and the RTI Activists of the
state will be meeting and discussing the problems and future strategy.
On behalf of HRLN and Public Cause Research Foundation (A Parivartan
Initiative), I would like to invite you for the meeting and to discuss about
the problems in Bihar on the implementation and interpretation of the RTI
Act. I would also like to request you to please circulate this invitation to
other groups and friends of the RTI movement and request them to come along
with specific cases that can also be discussed during the meeting. A formal
