Respected Sir,
I wish to humbly submit the following information for carrying out the Reforming
of the Promotional Policy laid down for the posts of Senior Accountants serving
in the Departmentalised Accounting Organisations of the Centralised Union
Ministries under the Administrative Control of the O/o The Controller General of
Accounts, Ministry of Finance, Department of Expenditure, Lok Nayak Bhawan, Khan
Market, New Delhi.

The details of the Organisational Set-up and working of the O/o The Controller
General of Accounts Organisation.
Consequent upon the separation of accounts from audit, the organization of
Controller General of Accounts was set up in 1976 under the Department of
Expenditure, Ministry of Finance. CGA is the technical policy making body on the
matters relating to Government accounting and exercise the powers of the
President under Article 150 of the Constitution of India to prescribe the Forms
of Accounts of the Union and State Government on the advice of the Comptroller
and Auditor General of India.

The Controller General of Accounts is the apex accounting body in the Government
of India. The accounts of the Civil Ministries are compiled and maintained by
the Pay and Accounts Offices, the basic accounting units.

The accounting setup is highly decentralized in the Civil Ministries. A Chief
Controller of Accounts or a Controller of Accounts heads the Civil Accounts
Units at the Ministry level and report to the CGA. The CCAs/CAs function through
a Principal Accounts Office at the Ministry headquarters and several Pay and
Accounts Officers at the field level are spread over India. The Pay and Accounts
Offices maintain a line for item wise accounts of all the transactions involving
Consolidated Fund of India, Contingency Fund of India and Public Accounts of
India. Various subsidiary accounts such as Loan accounts, Fund accounts etc. are
also maintained by these units.

The accounts compiled by the Pay and Accounts Offices are consolidated on a
monthly basis in the Principal Accounts Offices at the Ministry's headquarters.
The consolidated accounts of the Ministry are rendered to the Controller General
of Accounts. The accounts received from various Ministries are consolidated in
the office of the Controller General of Accounts to generate the accounts of the
Government of India as whole.These monthly accounts are reviewed and a critical
analysis of expenditure, revenue collection, borrowings and deficit is prepared
for Finance Minister. The PAOs have the authority to release payments on behalf
of the Government and to collect revenues of the government.

The cadre management of Group 'A' officers of the Indian Civil Accounts Service
(ICAS) vests with the Controller General of Accounts. It covers the entire gamut
of personnel management of ICAS officers including their recruitment, transfers,
promotions, training, both within the country as well as abroad and periodical
reviews of cadre strength and distribution.

The respective Chief Controller/ Controller of Accounts controls the Group 'C' &
'D' staff of various Civil Accounts Units. However, a combined seniority list of
all the employees within these grades is maintained by the Controller General of
Accounts for effecting promotions.

The details of the staff set-up under the O/o The Controller General of Accounts
is given as follows:-

The Recruitments to the post of Lower Division Clerk, Accountant and Senior
Accountant in the Central Civil Accounts Service.(Annexure-I is enclosed)

As per the powers conferred by the proviso of G.S.R.. 614(E)under article 309 of
the Constitution, and in supersession of the Central Civil Accounts Service
(Group 'C') Recruitment Rules, 1978, in so far as they relate to Lower Division
Clerk, Accountant and Senior Accountant, except as respects things done or
omitted to be done before such supersession, the President of India has laid
down the method of recruitment to the post of Accountant and Senior Accountant
in the Central Civil Accounts Service in the Departmentalised Accounting
Organisations of the Centralised Ministries  under the administrative control of
O/o The Controller general of Accounts, Ministry of Finance, Department of
Expenditure, Lok Nayak Bhawan, Khan Market, New Delhi. The copy of the CGA`s
Notification is enclosed for the Recruitments to the post of Lower Division
Clerk, Accountant and Senior Accountant in the Central Civil Accounts
Service.(Annexure-I is enclosed).

Accordingly, the appointment process of Accountants at the initial level of
recruitment is done through the Staff Selection Commission as follows:-

(1). The Appointment of Accountants (Pay scale- Rs. 4,500- 7,000 )

The appointment of Accountants is done by the Staff Selection Commission through
an open written examination conducted every year and through the process of
departmental promotions of Lower Division Clerks. The minimum educational
qualification for the recruitment of Accountants in the Pay and Accounts Office
(Departmentalised Accounting Organisation) of a Central Government Ministry
under the office of the Controller General of Accounts is a Bachelor's degree
from a recognized University.

(2).The next promotion is to the Post of Senior Accountant.
(Pay scale- Rs. 5,500- 9,000).

The Promotion of Accountants to the post of Senior Accountants is done for those
government personnels with 3 years of regular service and who have qualified the
Departmental Confirmatory Examination as per the terms and conditions specified
and conducted by the Controller General of Accounts (as per the common seniority
list drawn by the O/o The CGA in respect of all the Ministries on the basis of
seniority-cum-fitness (as per procedure laid down under sub-rule (2) of rule 5).

(3).The next Promotion is given to the Post of Junior Accounts Officer.
(Pay scale-6500-10500).

The Promotion of Senior Accountants to the post of Junior Account Officers post 
is done on the basis of passing of the Junior Accounts Examination conducted by
the O/o The Controller General of Accounts for the Selection  of  90% of vacant
posts and  the other 10 % of the vacant posts of Junior Accounts Officers  are
to be filled-up through the regular promotions on basis of
Selection-cum-seniority of Senior Accountants who are eligible for the
promotional avenues. Copy of the NOTIFICATION  issued by the CGA, New Delhi, the
2nd January, 2001 for promotion of Junior Accounts may be referred to which is
enclosed(Annexure-II).

i.e.The Promotion to the Post of Junior Accounts Officers post is done as
follows:-

(i).90% of the posts in the grade of Junior Accounts Officers shall be filled by
the promotion of Senior Accountants on the Seniority-cum fitness basis from a
common seniority list of Senior Accountants to be drawn up and maintained by the
O/o The  Controller General of Accounts of persons who have passed the Junior
Accounts Officer (Civil) Examination. The syllabus and conditions of eligibility
for the examination shall be such as may be specified by the Controller  General
of Accounts provided that the Controller General of Accounts may at his
discretion exempt any person who is qualified Chartered Accountant or Cost
Accountant from appearing in any subject in the said examination,

(ii). The other 10% of the posts in the grade of Junior Accounts Officer 's may
be filled up by promotion from  common seniority list to be drawn up and
maintained by Controller General of Accounts of Senior Accountants (pay scale
Rs. 5500-9000) who have  rendered not less than 10 years service in the grade on
the basis of Selection-cum-seniority and who have crossed the age of  53 years
as on 1st January of the year. For the purpose of this  clause service in the
grade of Senior Accountant shall include the previous service rendered  as
selection grade Auditor in  the Indian Audit and Accounts Department or the
organisation of the erstwhile Chief Pay & Accounts Officer.

For these promotions to the post of Junior Accounts Officers, the  Consultation
of the Union Public Service Commission is not necessary or required as the Posts
of Junior Accounts Officers belong to the  Central Civil Accounts Service, Group
'B' (Non-Gazetted) Ministerial post. The No. of posts to be filled-up every year
are Subject to the variation in the number of posts depending on workload of the
Accounting Organisations.

(4). Now, those Senior Accountants who have not passed the Junior Accounts
Officers Examination conducted by the Controller General of Accounts are never
promoted till their last days of retirement.

Even after working as Senior Accountants for nearly 35 to 38 yrs of Central
Government service, they are never promoted. As these posts of Junior Accounts
Officers belong to the General Central Services, Group 'B' (Non-Gazetted)
Ministerial posts, no parity has been drawn by the Central Government with the
promotional policy of the Group B &C of Central Secretariat Services (CSS) of
the Central Union Ministries vis-à-vis the  Central Civil Accounts Service,
Group 'B' (Non-Gazetted) Ministerial post for the posts of Senior Accountants to
be promoted as Junior Accounts Officers on regular basis in the line of their
Seniority positions.

1.Eligibility for Appoinment  is a minimum Bachelor's degree from a recognized
    University.
2.The Examination for recruitment is conducted by the Union Public
    Service Commission (UPSC) every year.

3.The details of promotions are:-

(a)The Junior Scale : First Appointment is of  Assistant Controller of Accounts
in the office of the CGA (Controller General of Accounts), Department of
Expenditure (Ministry of Finance) Delhi / or in the offices of the Chief
Controller of Accounts  in one of the  Central Government  Ministry  in the
Govt.of India.

(b).In the Senior Scale he is promoted as the Deputy Controller of Accounts. In
the Senior Administrative Grade he is promoted as the Chief Controller of
Accounts. He can also hope to become the Additional Controller General of
Accounts in the Additional Secretaries Grade. The highest career post for an
ICAS officer is Controller General of Accounts and has a salary fixed higher
than that of the Additional Secretaries' Scale.

As such, the promotion policy for Senior Accountants followed by the O/o The CGA
is totally unrealistic and a setback to the employees. The employee over a
period of time get demoralized and ultimately the work efficiency also tend to
decline. As these officials have to work very hard to fulfill the ever
increasing demands of the Accounting Organization, a positive view may kindly be
shown towards them for streamlining their promotional avenues urgently. Any
further delay would definitely harm the service interests of these hardworking
officials at the ground level. Here, I would also like to mention the details of
the workload the Accountants and Senior Accountants have to perform at the
ground level while working in the Departmentalised Accounting set-up of a
Central Government ministry (Pay and Accounts Offices). Over a period of time,
these officials become experts in their allocated work. Are they not entitled
for a regular promotional avenues? Over a period of time.

Waiting for promotions endlessly in one grade for nearly 30 to 35 is a curse and
has brought immense heartburn and a sense of de-motivation among the existing
Senior Accountants. It is quiet natural that every human being on earth will
expect a value on his / her career. To boost the staff from loosing interest in
work and develop a sense of better service motivation to the nation & above all
to preserve the dignity of Senior Accountants working in Central Govt. service,
it is very essential that a favorable regular promotional policy may be framed
and drafted urgently. Even the Assured Career Progression scheme implemented by
the Government of India for Senior Accountants is not realistic and is offered
when the employee reaches his maximum of the pay scale. Virtually there is no
Career Progression for these employees.

As such, the concept of promotions of Senior Accountants to the next high post
of Junior Accounts Officers should be introduced at the rate of 50 % on the
basis of Seniority of these Central Government employees and the next 50 % on
the basis of Limited departmental Examinations. This will ensure justice to the
demoralized Senior Accountants who have remained stagnant in their same posts
over a period of nearly 30 to 35 years of Central Government Service rendered by
these central government employees and no promotional avenues in sight.In this
regard the orders of the THE CENTRAL SECRETRIAT SERVICE RULES may be referred to
regarding the promotional avenues of Assistants to the post of Section officers
mentioned below for reference.

ORDER
Sub :  Change in mode of recruitment in the Section Officer's (SO) Grade of
Central Secretariat Service (CSS).
 	 The Government had set up a Committee on Cadre Restructuring of Central
Secretariat Service (CSS) in February, 2001.  The Committee submitted its report
in February, 2002.  The Report of the Committee has been considered by the
Government and inter alia following decisions, have been taken:

(i)To discontinue direct recruitment to the grade of Section Officer through
Civil Services Examination of UPSC.

(ii) To change the mode of recruitment to the grade of Section Officer by way of
50% through Limited Departmental Competitive Examination (LDCE) and 50% by
seniority.

2.The above decisions will be effective from 03.10.2003.

3. The Select List of S.O. grade for the years 2001 and 2002 against 40% quota
of vacancies each for LDCE and seniority is under finalization by this
department.  The vacancies against 20% quota, earmarked for Direct Recruitment
for the years 2001 and 2002 could not be filled up through Civil Services
Examination because the process of their certification through the screening
committee could not be completed by the respective cadres.  Even for the
examination 2003, no vacancies have been intimated to UPSC because several cadre
authorities have not yet furnished the information on this count.  In view of
this, it has been decided that the Select List for the year 2003 onwards shall
be prepared in accordance with the revised mode of recruitment by way of 50%
through LDCE and 50% by seniority.

4. Necessary notification relating to amendments to the CSS Rules will be issued
separately.

G.S.R.. 614(E).— in exercise of the powers conferred by the proviso to article
309 of the Constitution, and in supersession of the Central Civil Accounts
Service (Group 'C') Recruitment Rules, 1978, in so far as they relate to Lower
Division Clerk, Accountant and Senior Accountant, except as respects things done
or omitted to be done before such supersession, the President hereby makes the
following rules regulating the method of recruitment to the post of Lower
Division Clerk, Accountant and Senior Accountant in the Central Civil Accounts
Service, namely :—
1. Short title and commencement.—(1) These rules may be called the Central Civil
Accounts Service (Group 'C') Recruitment Rules, 2000.
(2) They shall come into force on the date of their publication in the Official
Gazette.
2. Definitions.—In these rules unless the context otherwise requires,
(a) "Appointing authority" shall have the same meaning as it has in the Central
Civil Services (Classification, Control and Appeal) Rules, 1965;
(b) "Cadre" means the cadres of Lower Division Clerk, Accountant and Senior
Accountant respectively. Each Ministry shall have its own separate and
independent cadres of Lower Division Clerk, Accountant and Senior Accountant
comprising of total number of posts, as specified in the Annexure to these
rules, in the respective grades of Lower Division Clerk, Accountant and Senior
Accountant;
(c) "Government" means the Government of India;
(d) "Commission" means the Staff Selection Commission or any other recruiting
agency for the cadres covered by these rules, which the Government may
constitute;
(e) "Controller General .of Accounts" means the Controller General of Accounts
in the Department of Expenditure, Ministry of Finance and includes Additional
Controller General .of Accounts or Joint Controller General of Accounts
authorised by the Controller General of Accounts to exercise powers under these
rules:
f) "Ministry" means a Ministry in the Government of India and includes a
Department of the Ministry or an Office specified in the Annexure to these
rules;
(g) "Organised Accounts Services" includes the Accounts Services in the
Departments of Audit and Accounts, Defence Accounts, Railway Accounts, Post and
Telegraph Accounts and Telecom Accounts in the Government;
(h) "Schedule" means Schedule annexed to these rules;
(i) "Service" means the Central Civil Accounts Service (Group 'C').
3. Number of posts, classification and scale of pay.— Number of said posts,
their classification and scale of pay attached thereto shall be as specified in
columns 2 to 4 of the Schedule annexed to these rules.
4. Method of recruitment, age limit, educational qualifications, etc.— The
method of recruitment, age limit, educational qualifications and other matters
relating thereto shall be as specified in columns 5 to 14 of the said Schedule
5. Regulation of promotion. (1) Promotion in the cadres of Lower Division Clerk,
Accountant and Senior Accountant shall be regulated by the Controller General of
Accounts as prescribed under this rule.
(2) (a) Where promotion is based on seniority-cum-fitness, each Ministry shall
hold a Departmental Promotion Committee meeting each year to consider all
eligible candidates with minimum qualifying service in the feeder grade as per
column 12 of the Schedule and prepare a select list of the candidates found fit
for promotion in order of their seniority and forward the same to the Controller
General of Accounts.
(b) From the said select lists, the Controller General of Accounts shall prepare
a Combined select list of candidates in accordance with the provisions contained
in sub-para (c) below.
(c) The combined select list shall be prepared by merging names from the select
lists of the ministries in order of seniority. The number of candidates to be
included in the Combined select list shall depend on the total number of
vacancies available in respective cadres in the Ministries on a date specified
by the Controller General of Accounts. The inter-se seniority of the candidates
from different Ministries in the Combined select list shall be determined on the
basis of length of service rendered by them in the feeder grade and in terms of
general principles for determining seniority in this regard as laid down by the
Government from time to time:
Provided that inter-se seniority of the candidates from the same Ministry shall
be retained in the Combined select list.
(d) The Controller General Of Accounts shall allocate candidates to the
Ministries from the Combined select list.
(3) (a) Where promotion is based on departmental qualifying examination, each
Ministry shall, in accordance with the directive of the Controller General of
Accounts, forward to it a list of candidates considered fit to appear in the
departmental qualifying examination.
(b) The Controller General of Accounts shall conduct departmental qualifying
examination from time to time and prepare a list of successful candidates who
secure percentage of marks as determined by the Control lei-General of Accounts.
(c) From the list of successful candidates prepared as per sub-para (b), a
select list of candidates in order of their seniority as per sub-para (d) below
shall be prepared. The number of candidates in the select list shall be
restricted to the total number of vacancies available under the departmental
qualifying examination quota unless otherwise ordered by the -Controller General
of Accounts.
(d) In the select list, the inter-se seniority of the candidates from different
Ministries shall be determined on the basis of the length of service rendered by
them in the feeder grade and in terms of general principles for determining
seniority in this regard as laid down by the Government from time to time:
Provided that inter-se seniority of the candidates from the same Ministry shall
be retained in the select list;
(e) The Controller General Of Accounts shall allocate candidates to the
Ministries from the select list.
(4) (a) where promotion is based on departmental competitive examination, each
Ministry shall, in accordance with the directive of the Controller General of
Accounts, forward to it a list of candidates considered fit to appear in the
departmental competitive examination.
(b) The Controller General of Accounts shall conduct the departmental
competitive examination from time to time -and prepare a list of candidates in
order of their merit in the examination.
(c) The number of candidates in the select list shall be restricted to the total
number of vacancies available under the departmental competitive examination
quota unless otherwise ordered by the Controller General of Accounts.
(d) The Controller General of Accounts shall allocate candidates from the select
list to the Ministries.
6. Transfer.—(1) the Lower Division Clerks, Accountants or Senior Accountants
shall be liable to serve any part of India.
(2) The Controller General of Accounts may, if satisfied that it is necessary or
expedient in public interest so to do, by order, and for reasons to be recorded
in writing, transfer a Lower Division Clerk, Accountant or Senior Accountant, as
the case may be, from one Ministry to the other in the same grade.
8. Disqualification.— No person,-
(a) who has entered into or contracted a marriage with a person having a
spouse.living; or
(b) who, having a spouse living, has entered into or contracted a marriage with
any person,
shall be eligible for appointment to the said post:
Provided that the Central government may if satisfied that such marriage is
permissible under the personal law applicable to such person and the other party
to the marriage, and that there are other grounds for so doing, exempt any
person from operation of this rule.
8. Power to relax.—Where the Central Government is of the opinion that it is
expedient so to do, it may, by order, for reasons to be recorded in writing,
relax any of the provisions of these rules with respect to any class or category
of persons.
9. Savings.—Nothing in these rules shall affect reservations, relaxation of age
limit and other concessions required to be provided for the Scheduled Castes,
the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special
categories of persons in accordance with the orders issued by the Government
from time to time in this regard.

have rendered 7 years regular service in the grade as per procedure laid down in
sub-rule(3) of rule 5.
		 (4) 10% in each cadre shall be filled by promotion on seniority basis through
common range of seniority.  Promotion from amongst Group 'D'employees who
possess Matriculation or equivalent qualification on seniority-cum-fitness
basis, as per procedure laid down in sub-rule(2) of rule 5.

qualify in the departmental competitive examination conducted by Controller
General of Accounts, as per procedure laid down under sub-rule (4) of rule 5.
Note : Promotees to the grade of Accountant who fail to qualify the Departmental
Confirmatory Examination as per terms and conditions specified and conducted by
Controller General of Accounts within two years from the date of' promotion are
liable to be reverted to the post which they held prior to their promotion as
Accountant.

writing, relax any of the provisions of these rules with respect of any class or

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age
limit and other concessions required to be provided for the Scheduled Castes,

have passed the Junior Accounts Officer (Civil) Examination. The syllabus and
conditions of eligibility for the examination shall be such as may be specified
by the Controller  General of Accounts provided that the Controller General of
Accounts may at his discretion exempt any person who is qualified Chartered ;
Accountant or Cost Accountant from appearing in any subject in the said
examination,
(ii) 10% of the posts in the grade of  Junior Accounts Officer 's may be filled
up by promotion from  common seniority list to be drawn up and maintained by
Controller General of Accounts of Senior Accountants (pay scale Rs. 5000-8000)
who have  rendered not less than 10 years service in the grade on the basis of
Selection-cum-seniority and . who have crossed the age of  53 years as on 1st
January of the year. For the purpose of this  clause service in the grade of
Senior Accountant shall include the previous service rendered  as selection
grade Auditor in  the Indian Audit and Accounts Department or the organisation
of the erstwhile Chief Pay & Accounts Officer.
Deputation :
Officers from any Organised Accounts service under the Central Government :
(i) Holding a post of Junior  Accounts Officer or analogous posts on regular
basis; or
(ii) Senior Accountants/Senior Auditors who have qualified  the SAS or
equivalent to Junior Accounts Officer Exam with , 3 years regular service in the
grade. The departmental Officers in the feeder category who are in the direct
line of promotion shall not be eligible for consideration for appointment on
deputation. Similarly, Deputationists shall not be eligible for consideration
for appointment by Promotion. (period of deputation including period of
deputation in another ex-cadre post held immediately preceding this appointment
in the same or other organisation/ department of the Central Government shall
not ordinarily exceed 3 years. The maximum age limit for appointment by
deputation shall be not exceeding 56 years as on the closing date of receipt of

Prologue:

The purpose of writing this essay is to look at the future of the
Republic of India from a very different perspective and with a strong
focus on the real identity and character of our nation. Unlike what
has been preached in our history books over the last 62 years, the
nation of India did not take birth on 15 August 1947. In reality;
Hindustan (also known as India) has existed on this planet earth
since 10th century BC. (In simple terms, this means that Hindustan
has existed for the last 3,000 years, at the least).

Hence, "We – The People of Hindustan"; must look at the future of our
country through a radical perspective that we hope will bring a
change in the thinking process among the people and lead to better
living and better life styles for all Hindustanis.

In this century, India is constantly and consistently under the
negative influence of Islamic terrorist activities, an incompetent
and impotent administration, aged and unfit political leaders whose
sole aim is self preservation, ever rising inflation and a cost of
living that far exceeds the actual real income of most of the Indian
population.

India can be and must be transformed into a vibrant and ever
advancing nation; powerful in all ways; with a strong emphasis on
education for all the people, social discipline, a powerful military
capable of defeating any enemy, an equally strong and independent
police force to control and suppress internal terrorism and above all
a nation that stands up and fulfills the ideals of fraternity,
equality and peace, This nation can only be: "Hindustan"!

To Be a Hindustani:

What is it that makes a person a Hindustani? This question has not
been answered in a complete and satisfactory manner over the last 60
years. In almost all cases "To be a patriot was to be a Hindustani"
was the most common explanation. However, this has never taken into
account the character or the self – esteem of the people of Hindustan
that contributes to the feelings of being a Hindustani. Pride, self-
esteem, honour are all vague terms that are confusing to the people;
regardless of their level of education. A paper degree that certifies
that a person attended 13 years of a prescribed educational system
does not automatically lead to that person having pride of belonging
to a nation or honor towards ones country. Pride is an emotion, which
refers to a strong sense of self-respect, a refusal to be humiliated
as well as joy in the accomplishments of oneself or a person, group,
nation or object that one identifies with, or to think of one's self
as being better than others. Self-respect reflects a person's overall
self-appraisal of their own worth, and encompasses beliefs of being
competent and with emotions of assertiveness and confidence. Honour
is the evaluation of a person's trustworthiness and social status
based on that individual's actions. Honour is exactly what determines
a person's character: whether the person reflects honesty, respect,
integrity, and fairness. These three emotions are the very foundation
of any nation and cannot be taught is a school curriculum. Pride,
Self-respect and Honour have to be an integrated part of life; just
as important as the need to eat food, drink water and breathe air.
Only then, can there be a true meaning towards being a Hindustani.

To achieve this intense character modification among the people of
Hindustan; we must begin at the basics; the very base on which the
foundation of the Republic of India was created; and that is the
`Constitution of India'. When any Hindustani studies the Constitution
analytically (without emotions), it is clear that the original
constitution has deep flaws that need to be repaired urgently. What
are the changes that we need?

1) Include the name of God in the Constitution! Every person in
Hindustan; regardless of their religion, believes the existence of
God and is spiritually bound to this concept. Yet, this very Creator
is not mentioned anywhere in the Constitution. Make no mistake, the
Constitution of India can be rock-solid and yet, flexible enough to
ensure the strength and prosperity of our country through good times
and bad times. Including a mention of `God" in this will only enhance
and validate the Constitution and in the eyes of everyone; will make
it a more powerful and stronger bed-rock for our country of Hindustan.
2) Abolish all personal religious laws in India! India as a
country must have only one set of laws that are equally applicable to
all citizens; regardless of their religious beliefs. The "Uniform
Civil Code" (UC2) is important to the strength and character of
Hindustan. The very existence of modern Hindustan depends on the UC2.
3) Abolish Article 370 of the Constitution with reference
Kashmir! The President of India issued the Constitution (Application
to J&K) Order under Article 370 of the Indian Constitution extending
the Union Constitution to the State with some exceptions and
modifications. Article 370; which is of a temporary nature, grants
special status to Jammu and Kashmir and virtually made it a country
within a country, with its own flag, emblem, and constitution. This
article specifies that except for Defense, Foreign Affairs and
Communications, the Indian Parliament needed the State Government's
concurrence for applying all other laws. Thus, the state's residents
live under a separate set of laws, including those related to
citizenship, ownership of property, and fundamental rights, as
compared to other Indians. Are the people of J&K more special than
the rest of the people of our country? Either Kashmir is an integral
state of the Republic (in which case special privileges under Article
370 must be abolished) or the nation has to accept the fact that
Kashmir is not a part of India and is still a disputed territory. The
People of India have to make up their minds on this issue once and
for all time to come.
4) Remove similar protections for unique status throughout the
Union of Hindustan! Similar protections for unique status exist in
tribal areas of India including those in Himachal Pradesh, Arunachal
Pradesh, and Nagaland.
5) Declare Hindustan as a `Hindu Republic'! There are 208
countries in the world today. (in the year 2008). Of these; 48 are
Islamic Republics, 8 countries have Islam as their national and
official religion, and 139 countries have their constitutions based
on the principles of Christianity or follow Christianity as the
official religion. Six (6) countries have Buddhism as the official
religion, One (1) Roman Catholic State (Vatican), one (1) Jewish
State (Israel); five (5) countries are Communist and there used to
exist one (1) Hindu State of Nepal, which is now a Communist state.

Today, there is no existence of even one Hindu Nation on the face of
this planet.  80.5% of the 1.1 billion people of India are Hindus,
constituting 1/6th of the world population (more than 800 million
residents of India); yet the country and its government are ashamed
to declare it a Hindu Republic. Why is it so? Are the Hindu people
afraid? Moreover, if they are afraid; what are they afraid off?
6) Disallow Criminals from contesting elections or being
nominated to public office:  Over the last 18 years, since the fall
of the Rajiv Gandhi government in 1989, India has seen a rapid rise
of criminals in politics.

These new criminal- politicians are the reason that India is not
making any progress in the 21st century. The law is today a
prostitute that can be screwed by any small time criminal that has
some affiliation to any political party. As people lose faith in the
legal system, the mafia has started ruling the country. At what point
will the nation break up because the central government is so weak
that the criminally backed state governments declare themselves
independent? In 2008, the nation already faces rebellion from the
North Eastern States, Punjab and parts of Tamil Nadu and Kerala.
7) Declare Capital Punishment as mandatory for Murder,
Kidnapping, Rape, Human trafficking, Narcotics trafficking and Crimes
against the State:

The first eight years of the 21st century has seen a rapid and
unstoppable crime wave in almost all areas. The National capital has
the infamous reputation of highest reported rape cases every year.
The majority of the victims (more than 70%) are minors or teenagers.
Of these reported cases less than 50% actually make their way to the
courts and less that 2% of the accused are found guilty. With such a
miserable record of Crime and No Punishment; successive governments
have not only failed in their duty to ensure the protection of the
citizens; but have also set up a unspoken policy where women are
considered second- class citizens.While all or some of the above
stated modifications may not bring about an immediate change in our
society, they will definitely make the state law enforcement
machinery more confident in applying the laws as well as ensuring a
more disciplined society.


The Uniform Civil Code (UC2):

What is a "Uniform Civil Code"? Uniform Civil Code is a term, which
has originated from the concept of a Civil Law Code. It envisages
administering the same set of secular civil laws to govern different
people belonging to different religions and regions. This supersedes
the right of citizens to subject themselves to different personal
laws based on their religion or ethnicity. The common areas covered
by a civil code include:
• personal status
• rights related to acquisition and administration of property
• marriage, divorce and adoption
Usage of this term is prevalent in India where the Constitution of
India lays down the administration of a uniform civil code for its
citizens as a Directive Principle, but has not been implemented until
now. In a major development, the Supreme Court of India on 23 July
2003 regretted the non-implementation of a Uniform Civil Code while
hearing a petition pertaining to the Indian Succession Act.
Delivering its verdict, a three-judge bench regretted that Article 44
of the Constitution had not been given effect to even after over 50
years of independence.
[Article 44, under the Directive Principles of State Policy, says -
The State shall Endeavour to secure for the citizens a uniform civil
code throughout the territory of India.]
The bench, comprising Chief Justice V N Khare, Justice S B Sinha and
Justice Dr A R Lakshmanan, was hearing a petition challenging section
118 of the Indian Succession Act, 1925, which prevents Christians
from bequeathing property for religious and charitable purposes.
"We find that section 118 of the Act being unreasonable is arbitrary
and discriminatory and, therefore, violative of Article 14 of the
Constitution,"

Justice Khare said.
[Article 14: Equality before law - The State shall not deny to any
person

equality before the law or the equal protection of the laws within
the

territory of India.]
"We would like to state that Article 44 provides that the State shall

endeavour to secure for the citizens a Uniform Civil Code throughout
the

territory of India," Justice Khare said.
"It is a matter of regret that Article 44 of the Constitution has not
been

given effect to. Parliament is still to step in and frame a common
civil

code in the country. A common civil code will help the cause of
national

integration by removing the contradictions based on ideologies."
"For the reasons aforementioned,  Section 118 of the Indian
Succession Act

is declared unconstitutional being violative of Article 14 of the

Constitution of India," Justice Khare said.
Justice S B Sinha and Justice A R Lakshmanan also passed separate
orders

agreeing with Chief Justice V N Khare.
Justice Sinha said that the provision in question was enacted to
prevent

persons from making an ill-considered deathbed bequest.
"The objective behind the said legislation was, therefore, to protect
the

section of illiterate or semi literate persons who used to blindly
follow

the preachers of religion."
"Such a purpose has lost all significance with the passage of time,"
he wrote in his order.

The fact remains that the country of India is Democracy; based on
the `will of the people'. Under this very principle; the will of
80.5% of the Hindu population should prevail in the functioning of
its Government and should influence the Laws of the Land, which
should be based on and derived from early translations of Sanskrit
texts known as Dharmaúâstra, the treatises (úâstra) on religious and
legal duty (dharma). Dharmaúâstra contains what may be
called "jurisprudence", i.e. a theoretical reflection upon practical
law, but not a statement of the law of the land as such.  Another
sense of Hindu law, then, is the legal system described and imagined
in Dharmaúâstra texts. In reality, however, the current legal system
is based partially on the Common Law concept. Partially, because in
India; civil matters are still subject to the Religion based laws for
each community, specially the Islamic, Christian and Parsee
communities. Common law originally developed under the inquisitorial
system in England during the 12th and 13th centuries, as the
collective judicial decisions that were based in tradition, custom
and precedent. The form of reasoning used in common law is known as
casuistry or case-based reasoning. The common law, as applied in
civil cases (as distinct from criminal cases), was devised as a means
of compensating someone for wrongful acts known as torts, including
both intentional torts and torts caused by negligence, and as
developing the body of law recognizing and regulating contracts.
The reality is that use of religion based laws contradict the very
principles of the Constitution; which assures the citizens of
Hindustan; "Justice, Equality and Liberty". How can the citizens be
equal if their lives are subject to different religion based laws?
How can there be equality, when many religious laws discriminate
against women? The Constitution of India is supposed to be
the `Supreme Law of India'; yet it is always made inferior to the
religious laws of the minority communities. It is time that the
Constitutional Law is effectively made the only and supreme law in
India and all religious based laws are declared illegal in
India. This can only be achieved by implementing the Uniform Civil
Code.

Minorities who do not agree to the Uniform Civil Code have the choice
and the freedom to leave the country of Hindustan and find other
countries who laws they agree with for their lifestyles. Hindustan
will guarantee freedom of speech, thought and action; but also of
freedom after speech, thought and action; for every person inside the
Republic.


Illegal Migrations into Hindustan:

Since the 1990s; India has experienced an influx of migrants into
India from all over the South East Asia/ Africa nation. Today in
India; we see communities in thousands from African countries
(Ethiopia, Eritrea, Nigeria, Kenya, Sudan and Somalia are maximum),
Iran, Iraq, Afghanistan, Pakistan, Sri Lanka, as well as from the
former Soviet countries of Kazakhstan, Azerbaijan, Armenia. Most of
these are illegal immigrants that feed off the country's economy and
infrastructure and do not contribute anything in return. Illegal
migrants from Bangladesh are the biggest problem. Narcotics
trafficking, kidnapping, rapes, murder and attacks against the Indian
nation can be directly attributed to the nationals of the above
countries.

The Indian government does not have a policy to address the issue of
this illegal immigration. Further; the problem is made worse by
illegal migrants being used as cheap labor by Indians in their houses
and factories. Unless the government enacts laws that prosecute
Indians who employ illegal migrants; the nation of India will always
be at risk of over population, disease and crime.

How can this problem be resolved?

a) By introducing Bio-metric citizens ID cards for all Indian
nationals over the age of 11. This has to be mandatory.
b) Illegal migrants to be punished by strict laws that enforce
them to work in hard labor camps.
c) Indian nationals who employ illegal labor to be punished with
punitive fines.
d) Politicians & bureaucrats who help politicians into
registering these illegal migrants into vote banks should face
capital punishment for subverting the integrity of the nation.
e) Re-introduce the death penalty for Treason. Any and all
actions by Indian nationals that subvert the integrity and unity of
the Nation of India to be punished. Those nationals convicted of
treason to be hanged in public.

PRO – HINDUSTANI IS NOT `ANTI' - ANYBODY

It has to be understood by all the citizens of India and the world
over that our Pro – Hindustani approach is not Anti to any other
religion or faith. We, as proud citizens of Hindustan have the
absolute right as Human Beings to define an identity for ourselves
and our country. The majority of the nationals of India are Hindu –
Sikh. It is very correct that the nation be called as "Hindustan" –
the place of the Hindus. Changing the name of our proud country will
change its image and make the people of India self – respecting and
proud of their national identity. There will not be any major changes
to the constitution. Every citizen of Hindustan; regardless off his/
her religious affiliation will be equal in all respects. There will
be no confusion towards implementation of criminal and civil law or
towards civil rights and the rights of Women, Children and those who
are handicapped. Every citizen will be equal in all respects and that
is what the People of Hindustan aspire for!

It is possible that minorities who prefer their religious laws over
the Hindustani Constitutional law will be unhappy and will protest
against this change. They will have a choice. Either accept and obey
the Constitution of Hindustan and be equal in all respects or leave
Hindustan and be happy elsewhere. The people of Hindustan will not
prohibit anybody from seeking a better life, in the country or
outside off it.

The Urchins of India – A lost Generation:

It is estimated that at any given time there are between 18 million
to 22 million homeless children living on the streets of India. These
are very rough estimates because the sheer number of homeless
children and their mobility from one city to another prevents a
specific survey of the situation. Most children have fled from
abusive parents, starvation or worse. Some have simply been abandoned
by those who gave birth to them. The issue is not that these children
exist on the footpaths & railway stations of India. The real issue is
that they are citizens of India and as such they have rights under
the Constitution. These homeless & abandoned children are entitled to
the same comforts and security as the President and Prime Minister of
India.

It is the duty of the government to ensure that these children; who
are the human assets of the nation have the opportunity to a good
education, wholesome food and a safe and secure place to live in so
that they can have life of a normal human being. Since the day
of `Independence'; successive governments have outsourced the welfare
and concern of the homeless to charitable organizations; thereby
avoiding all responsibility towards a section of its own citizens.
Most of these kids grow up to be criminals who add to the crime and
lawless acts inside the country. This has to change!

In Hindustan; the Government will be forced by law to take the lead
to build children's hostels where the homeless children can find a
place to have a secure life. Such hostels have great value since it
builds a section of society that is educated, healthy and with
trained skills that will contribute to the economy of the nation. The
lost generation has to be rescued, not only for humanity and charity;
but to add to the talents and skills of the nation and to its assets.

National Health Care:

Much has been said by various governments regarding the health care
that has always been promised to the nation but never delivered. Over
the last 62 years of independence from British rule; there are only a
handful of hospitals, mostly located in the major metro areas that
are capable of providing health care and emergency life support to
the citizens of India. Average citizens have to travel 100 plus
kilometers to avail the medical assistance of these hospitals. While
the government may boast that these hospitals are for the people, the
reality is most of the medical facilities are available to those who
can pay for it in hard cash. The masses have to suffer delays and
indignities at these hospitals to get even the basic medical
assistance.

A major change can be effected by re-introduction of the `Cottage
Hospitals" in every town and district of India. Cottage hospitals
have been extremely effective in the past in providing medical
assistance and emergency medical help to the locals in the shortest
time. Cottage hospitals can be either government owned and offering
free medical aid or can be private owned and run as a business for
profit (as they already are in most districts). The sole focus of the
National Health Care system will be to ensure that medical aid is
available to the people within the shortest distance and time – span.

All of the above can be effectively achieved only & ONLY when the
country has the backbone of the Citizens ID card and the Uniform
Civil Code (UC2).

Indian Expatriates and their position with Hindustan:

There are over 22 million expatriate Indians living in various parts
of the world. Off these approximately 6 million are living in the
Gulf nations of Kuwait, Saudi Arabia, Bahrain, Qatar, Oman and the
Emirates. There is a radical difference between Indian expatriates
who live in the above mentioned countries and those who live in other
countries of the world. Except in the Gulf countries; most
expatriates qualify to be citizens in their new countries of
residence. It is only in the Gulf countries that regardless of the
time that the Indians are residents; they do not qualify to be
citizens. Thus, Indian passport holders stay on for decades and now
for generations in the Gulf countries as residents. That is the
policy of the host nations and Hindustan cannot have an issue with
that policy.

However, these Indian passport holders enjoy the security and
convenience of the Indian constitution at all times without
contributing much to the economy of India. The expatriates claim that
they transfer a few billion dollars every year to India. Yet, they
will not state where this money is actually generated.  Most of these
six million expatriates are employees with an average salary off US$
12,000 per year. Their saving after expenses is less than 15% off
their gross income. Assuming that they send back half their savings
to their families in India; the gross amount that is being
remitted is approximately US$ 5.5 billion. Most of these remittances
are used by the families in the purchase of land assets and immovable
property. While it helps individual families to become richer, these
remittances do not directly propel the economy of India.

Expatriates should be made to pay for the protection and rights that
they enjoy as citizens and as holders of our Country's passport. An
expatriate tax should be levied to offset the cost of services that
are provided by the Consulates and Embassies to our citizens abroad
and most of this income should be invested in infrastructural growth
of Hindustan. It is envisaged that if each of the 10 million
expatriate passport holder(s) is charged a fee of US$ 500 per year,
it will generate a foreign cash flow of $ 5 billion per year towards
direct investment in the Indian economy and infrastructure
development. In a 5- year plan these 25 billion dollars will make an
immense difference in our infrastructure development and boost the
economy to higher levels.

In the modern world the driving force behind major activity of the nation is
money. 90% population of the country is directly or indirectly depends on some

If all transaction of the country is routed through the banking system, it will
change the destiny of the country. There will be 10 times growth in the banking
sector itself. It will create a huge opportunity for trade and employment. The
banking system will be empowered by financial growth. This will create chain

8. How we can remove the fear of tax officials in the country?

Abolish cash currency in the country above Rs.50/-
Remove all forms of tax systems like Vat, Income Tax, Excise duty, Service tax,
Stamp duty, Corporation tax etc.
Introduce transaction tax of 2% on banking turnover.
Merge all tax departments in to one tax department.

9. What will be tax collection in total?

The total tax collection of the country by state and central Govts is 5 Lakh
crores now. The total turnover of all banks put together is 3 crores crores. 2%
of banking turnover is 6 lakh crores. So the Govts will get its total tax
collection with the current turnover of the banking system itself. But what
about the future growth once we introduce transaction tax system. The collection
will multiply ten times. (The figures are approx)

10. What is chain reaction?

Once transaction tax is introduced, the Government and banks can lend more money
back in to agriculture, trade, industry, research, infrastructure and
development projects. This will lead to
Employment generation in all sectors of the country.
Financial growth.
Corruption and bribe free transactions.
Quality infrastructure for health and education.
Well-planned roads, residential, commercial and industrial townships.
Global approach in trade and profession.
Quality products for quality people.
Elimination of poverty.
Young and dynamic political leadership.

11. How can we bring complete black money in to the banking system?

The Govt should fix the time limit to deposit all the cash in to the banks.
Then ban the currency above Rs.50/-
No body should ask any questions about the source of the money.
Introduce transaction tax from the next day.

12. What will be the over all scenario look like after transaction tax system?

I vision a liability free, corruption free strong economy. It is like people
riding electric vehicles in their city. A pollution free healthy atmosphere all
over.

My fellow Indians;

As we approach the next general elections, here are certain points
for the consideration of every proud indian:=

Today, as we enter the 9th year of the 21st century, the nation of
India is very much on the threshold of a quantum change. While, on
one hand the nation is still has age old problems of inadequate
supply to our citizens of food, drinking water, clothing, housing,
medical facilities and in turn a growing corruption; on the other
hand, the huge knowledge pool of scientists, software engineers and
other technically talented persons have given India the possibility
of being a very powerful nation on this God's earth. It is
imperative, that we bring forth political changes and formulate bold
national and international policies that will enable India to
alleviate the problems of the majority of our people and pave the way
to being a strong, independent and forceful nation.

The issues facing the nation in this new century can be broadly
categorized as follows:

1. Basic amenities for the People.
2. Social discipline and crime.
3. Government and institutional corruption.
4. International policy.
5. De-centralization of the government organizations.
6. Immigration and illegal migrations.

The above areas of concern have to be addressed in the form of long
term policies and with a strong will and desire to surmount the
practical difficulties in achieving the objectives; the prime
objective being the transformation of India into an independent, self-
  sustained economic global power.

1. Basic Amenities for the People:

The recent assembly polls in various States have shown; the issues
that are affecting the people (the electorate) are that of food,
drinking water, education and employment. The reality is that most of
the rural areas and many urban areas of India do not have the basic
facilities that are required to bring about an economic revolution
that will uplift the social conditions of the people. A real
requirement in India is that of 4-lane tarmac roads that connect
cities to the smallest of the towns. Roads are not only required, but
are necessary for the smooth transition of goods and services to each
and every town in India, thereby allowing for a rise in the economic
turnover. A well-built and properly maintained road system will bring
in the other infrastructure of power generation stations and
industries, thereby leading to job opportunities and rising economic
standards.

Properly maintained road infrastructure will give rise to investments
in both the industrial and farming sector, help in the rapid movement
of food, water and medical facilities, upgrade the efficiency of the
Public Distribution System and make the people aware of the interest
of the government in their well being. The project of building roads
will also help the unemployed (especially those who are still
illiterate) to get steady jobs, and allow their next generation
access to educational facilities.

Such an envisaged road network will allow for increased and equitable
distribution of raw materials and also increase market competition of
consumer goods, thereby leading to reduced prices and improved
product quality; a quantitative increase in industrial production to
feed the demand that will be created by increased consumer spending;
improved transportation of facilities and services to all areas,
thereby increasing the levels of literacy through an easier access to
educational institutions and education material, as well as ensuring
faster deployment of police and troops in times of social and natural
crisis.

The investment in road building will also help in attracting foreign
direct investment into the country. Companies in foreign countries
cite this lack of infrastructure as a major reason that prevents them
from long-term investment into India. The cost of road building can
be outsourced to FDI (similar to the Golden quadrangle project) as
well as to private Indian construction companies on a BOOT basis,
while the balance could be sourced out of government investments at
state and district levels.

2. Social Discipline and Crime:

The issue of the lack of social discipline and the growing criminal
tendencies cannot be ignored any longer. The growing criminal
activity is a direct result of socio-economic-political factors and
can be attributed to a succession of weak governments and an even
weaker and inappropriate legal structure. Criminality is on the rise,
simply because the mechanism of law and order and prosecution of
crime is both inadequate and slow in its process.

This problem can only be tackled by a complete overhaul of our legal
system and its mechanisms. While legal luminaries in India could give
much better advice on the changes required in our legal system, the
basic requirement is making the courts more people friendly and
efficient. It is strongly believed that a `jury' system will not only
ensure a fair trial for the accused, but will also ease the strain
that is put upon the judges as they singularly tackle an ever
increasing work load.

A social code of conduct is required on an immediate basis that not
only prescribes the way that the individuals should conduct
themselves in public places, but would also emphasize the manner in
which social groups have to conduct themselves as a whole. This code
of conduct, strictly enforced, will definitely reduce the social
crimes that afflict the majority of our people today. This will not,
in any form or manner, impinge upon the individual's right to
privacy, but will help in streamlining social interaction amongst the
people. Social code of conduct would cover the areas of noise
pollution, cleanliness in the streets and in municipal wards, ease of
removal of garbage, prohibit the misuse of public areas as open air
urinals and latrines, prohibit the use of public areas as spittoons,
and allow for a smooth and easier use of public facilities like
footpaths and foot bridges.

The removal of footpath vendors would be a prime concern towards a
better and safer use of footpaths, as would be the redesigning of the
pubic facilities for use by handicapped persons.

Most of the social issues in our nation today can be attributed to a
weak mechanism for prosecution of crime. Criminality has been
glorified as a medium of social change, but this in fact has proven
(by recent events all over the nation) to be precursor in organized
crime involving all strata of society and the bureaucracy. Crime
prosecution figures are as varied as the groups that poll these
figures. But, the perception amongst the general population is that
much of the criminal activity is unchallenged by the government;
thereby reinforcing in the mind of both the people and the criminals
that the rule of the law is weak and impotent. The suggestions for
improving the current situation are as follows:

a) The immediate deployment of Citizens Identity Cards.
b) Upgrading of the police and law enforcement departments with
modern machinery to track and investigate crime and persons
associated with criminal activities.
c) Sharing of information of criminals amongst city, state and
central law enforcement agencies on a real time basis to ensure a
free flow of information for prevention of crime.
d) A stronger and affirmative legal structure that allows for a
faster prosecution of criminals.
e) A hard labor based punishment policy for criminals that allow
the society to utilize the physical and mental talents of convicted
criminals.
f) The re-introduction of corporal punishment for those guilty
of social crimes.
g) A provision under law to appropriate and sell assets of
economic and serious crime offenders, in order to confiscate illegal
earning and return them to the government treasury, which in turn
will self-finance the criminal prosecution efforts.
h) The restoration of the death penalty for heinous crimes such
as pre-meditated murder, kidnapping, rape, armed robbery and
narcotics trafficking.

It has been proved in societies around the globe and over periods of
time that a successful and strong nation is always the result of the
strength of character and discipline among its individual citizens.

3. Government and institutional corruption:

Recent disclosures in the media have made a huge impact on the
people, regarding the growing corruption among the government
officials and the bureaucracy and the connection of the bureaucracy
(especially the police) to organized crime. Middle class population
is fast joining the disgruntled ranks of the population that are now
feeling anti government sentiments; and if the issues are not tackled
on an urgent basis this resentment might well turn into a issue of
civil rioting and physical attacks on government institutions; as can
be seen by the fact that there are already attacks on offices of
block development officers and other unarmed civil service offices.
The lack of a strong legal system, compounded with a lack of moral
authority has given rise to organized political-criminal activities.
Socio-economic-political issues have already contributed to the ever-
growing organizations like the Naxalites and the Maoist rebels that
have taken to armed rebellion. The nation cannot afford a civil
rebellion from its middle class, since that will invariably lead to a
civil war. There are those who might think of this scenario as
extreme and implausible should look at the various failed African and
Balkan states that were once a shining example of democratic nations
with a wealth of natural resources and human talents; yet today are
in the grips of a protracted civil war.

The rise of local and regional political parties has always been
considered to be a strong point of a vibrant democracy. However, the
freedom of political action has been misused by political parties
with extreme vision, who exist solely because the bigger parties with
a national agenda have not been able to take their ideas to the
People in a manner that convinces them of the responsibility of the
party ideals. This lack of communications leave a vacuum that is
quickly filled with a regional party with a narrow agenda based on
self survival and short term options. While the functionality of a
regional political party is debatable; the success of such
organizations and indeed their growing popularity is a grim reminder
of the failure of the national parties to consolidate on their
stature and their status as national leaders.

One of the prime reasons of the failure of the national parties
across the all areas of the nation is the nexus of criminal elements
of the bureaucracy working jointly with the criminal elements of the
local parties for partisan monetary gain, at the cost of the
exchequer. The cost of the damage that such a government has cost to
the specific state and also to the country in financial terms is
still being calculated. But, much larger and long term is the cost in
terms of credibility and stature that is now associated with the
nation as a whole. Such criminal enterprises flourish, specifically
because the law of the land is weak in application, as also for the
fact that the centralization of the bureaucratic hierarchy prohibits
scrutiny from the people of the activities of the government
functionaries. One way to reduce this corruption and criminal nexus
would be to decentralize the functioning of the bureaucracy all the
way down to the Panchayat levels. Decentralization would also have to
include the segregation of the central bureaucracy from the state and
local government bureaucracy, making each an independent autonomy not
dependent on the State or Central government for local issues.

	 4) International Policy:

In all international circles the image of India is that of a weak,
corrupt and backward nation without a strong leadership. Regardless
of who was in power, over the last 20 years our nation has reinforced
its image as that of a `loose confederation of warring tribes' rather
than of a Unified and strong single country. This image of being a
weak nation has invited terrorism and violence on an unprecedented
scale since 1947.

The only way that India can change its image internationally is by
changing itself internally. For that India needs to:

a) Develop strong leadership at the Central level to include 2nd
generation leadership.
b) Upgrade its armed forces to 110% of the current armed
strength off its closest rival China.
c) Refuse any and all technical and financial aid from foreign
countries.
d) Allow local industries to develop technology for all
requirements of the nation, including that of its armed forces.
e) Stop purchasing second and third hand technology from the
West.

Today's reality is that India is a beggar nation. Our Prime Minister
begs for technology and the Finance Minister for money. Corruption
has become a way off life rather than an exception. This needs to
change if India has to progress.

As conflicts around the Asian sub-continent and Africa gathers
intensity, India can play a dominant role is providing aid to the
average people in these conflict areas by supplying them with
essential food, medications, hospital equipment and clean drinking
water. All these items are readily available in India and can be
easily transported to the conflict areas. India can improve its image
if it projects its power beyond its neighboring boundaries. A strong
military might that backs up a stronger humanitarian force will make
all Indians proud of their heritage, culture and the nation.

5) De-centralization of the government organizations.

India is a political and social mess as a direct result of
centralization of the government. Small minded people in Delhi who
have never lived in the outer areas of the country decide on a
uniform policy for a nation that has inside its boundaries a variety
of cultures and languages. The central government's role has to be
restricted to that of making the policy and then monitoring its
deployment downwards to each district, town & village inside India.

The real execution of the Government policy is best carried out by
State and local governments who understand the cultural and social
requirements of the people. The district governments and village
Panchayats can play a positive role in development if correctly
guided by the Central & State Governments.

Development has to be ensured by using the 5- Years Plan methods.
This worked well in the 1960's and 70's. It can work again. By law it
must be insured and ensured that political parties or new Governments
cannot change a 5 year plan and all citizens must me required by law
to follow the guide lines of the 5- years plan(s) to assure the
nation that progress will be achieved per the set goals. Those who
oppose the plans or attempt to modify it should face harsh
punishment.

It is the duty of every Government to listen to the needs off its
people and to formulate policies that help the people lead a safe and
comfortable life in all strata of society and across all cultural
boundaries.

	 6) Immigration and illegal migrations.


India is facing a gigantic law and order problem that is largely
contributed for by the illegal migrations from Afghanistan, Pakistan,
Sri Lanka, Nepal and the African nations. Illegal migrants from
Bangladesh are the biggest problem. Narcotics trafficking,
kidnapping, rapes, murder and attacks against the Indian nation can
be directly attributed to the nationals of the above countries.

The Indian government does not have a policy to address the issue of
this illegal immigration. Further; the problem is made worse by
illegal migrants being used as cheap labor by Indians in their houses
and factories. Unless the government enacts laws that prosecute
Indians who employ illegal migrants; the nation of India will always
be at risk of over population, disease and crime.

How can this problem be resolved?

a) By introducing Bio-metric citizens ID cards for all Indian
nationals over the age of 11. This has to be mandatory.
b) Illegal migrants to be punished by strict laws that enforce
them to work in hard labor camps.
c) Indian nationals who employ illegal labor to be punished with
punitive fines.
d) Politicians & bureaucrats who help politicians into
registering these illegal migrants into vote banks should face
capital punishment for subverting the integrity of the nation.
e) Re-introduce the death penalty for Treason. Any and all
actions by Indian nationals that subvert the integrity and unity of
the Nation of India to be punished. Those nationals convicted of
treason to be hanged in public.
